I am not a lawyer….

But does Aer Lingus’s Conditions of Carriage (Now referred to as CoC) make very little sense? I’m currently going through them to see if there is any way of getting my money back, the fight on the customer service front isn’t going to plan at the moment but when the only way to contact them is by fax or post…. You are stuck dealing with reservation agents.

So I’m looking over everything and their fare rules say no refunds unless you are on a business class flight. Or as the rules say

NO REFUND AT ANY TIME EXCEPT FOR BUSINESS CLASS

However when you look at the Conditions of Carriage you see the following:

2.5 CONDITIONS PREVAIL OVER REGULATIONS

Except as provided in these Conditions of Carriage, in the event of inconsistency between these Conditions of Carriage and any other regulations we may have, dealing with particular subjects, these Conditions of Carriage shall prevail.

So when I’m reading that it looks like to me, if there is something in the fare rules which doesn’t agree with the conditions of carriage, the conditions of carriage win over, but they also say this:

3.1.3 Some Tickets are sold at fares which may be partially or completely non-refundable. You should check the fare rules at the time of booking and choose the fare best suited to your needs. You may also wish to ensure that you have appropriate insurance to cover instances where you might have to cancel your Ticket or are prevented from travelling.

But since I’ve just proven the fact the fare rules don’t seem to apply any more that statement is pretty much usless And section 4.2 goes:

If you do not travel, you may apply in writing for a full refund of taxes, fees and charges paid, in which case the refund may be subject to a reasonable administration charge.

So in theory if I wasn’t to travel on that flight I could claim a full refund (bar an admin charge for the refund itself) since under section 4.2 of their CoC it says if I don’t fly I get a refund.

But when you look at Article 10 - Refunds, it seems to be promising for me with one snag.

ARTICLE 10 - REFUNDS

10.1 We will refund a Ticket or any unused portion, in accordance with the applicable fare rules or Tariff, as follows:

10.1.1 Except as otherwise provided in this ARTICLE, we shall be entitled to make a refund either to the person named in the Ticket or, to the person who has paid for the Ticket, upon presentation of satisfactory proof of such payment

10.3 VOLUNTARY REFUNDS

10.3.1 If you are entitled to a refund of your Ticket for reasons other than those set out in 10.2, the amount of the refund shall be:

10.3.1.1 if no portion of the Ticket has been used, an amount equal to the fare and any taxes, fees and charges paid less any reasonable service charges or cancellation fees;The rules in 10.2 cover the following: “If we cancel a flight, fail to operate a flight reasonably according to schedule, fail to stop at your destination or Stopover, or cause you to miss a connecting flight

If you look at 10.1 it says “in accordance with the applicable fare rules” but section 2.5 seems to invalidate the fare rules, so I’m not sure where I stand with them on that part. However I think since I have proven their fare rules are not in line with their CoC so the fare rules don’t apply anymore so that section is null and void so I can get a full refund if I don’t fly with that ticket.

So this is my thinking, if I was to book another ticket with Aer Lingus at the lower rate and not fly using the higher priced ticket I can claim a full refund on it and get my money back. Would anyone with a more detailed knowledge of contract law care to look over my ideas?

Aer Lingus pricing ideas suck

I had to book my flights to San Fran to head off with the guys from PaddysValley in December so I booked my flights last night before I headed off to Scotland (Yes I’m  there now) checking up on my twitter feeds I saw Damien mention price today was around 500 euros.

I was gobsmacked. Last night they charged me 830 euros for the same flight. I went on to the Aer Lingus site and low and behold the total for the flight today is 485 euros. Flicking through their site it said you can change flights so I went and rebooked them at a different fare and they charged me 70 euros for the privilege. But of course when you read the fine print, oh if you get a lower fare we’ll hold on to your money. A big fuck you really.

How the hell does a price difference of 345 euros suddenly appear overnight. Needless to say I’m pissed at the moment.

The Hitchhikers Guide to the Class-2 Medical Exam

After an hour and half in the doctors office of various different exams for my class-2 medical. Here is what I think everyone taking it should know.

Do not take a whiz before you go. You need to give a urine sample when your there

“Ok, we need a urine sample from you” “But I’ve just gone! I have nothing left to give”

Don’t be afraid of needles. Since this would be my third or fourth time being poked with needles for blood tests etc I told the nurse to go straight for the veins in my hand since I know those work but she was talented enough to find one in my upper right arm. Hats off. They’ll take about 5 vial sized samples from you.

An ECG will be taken. Make sure you are very relaxed and don’t move as it tends to throw it off. I had the test done three times before they were happy with the results.

The IAA checklist for medical history is hefty enough, you’ll go through alot of things before it can be ticked off.

If you wear glasses make sure you bring your prescription with you. I’m going to have to fax mine in now.

If you are under thirty the cert is valid for 5 years. As you get older the length of validity for the test drops.

Thats all that comes to mind about it really. Assuming nothing weird pops up in my blood tests when the results come back I will have passed!

Whats new?

Its been a while since I’ve posted anything new and so long that its disappeared off my recent entry list in firefox.

So whats new in my life:

Leaving Cert Mocks start on the 5th of Feburary.

I. am. fucked. and yet strangely calm about it. Its just a piece of paper at the end of the day and there are always another way of getting to do the things you want. For college I’m looking at Computer Applications in DCU followed by Computing in DIT.

I got an email from Flightwise telling me that groundschool is starting shortly and I’m debating with my parents should I do it or not because it might impact on my leaving cert. Sometimes is so tempting to shout out NEWSFLASH DON’T CARE ABOUT THAT. I’M ALL ABOUT NOW AND THATS ABOUT 6 MONTHS AWAY.

I have some books on the way from Amazon of which one is the Cisco CCNA book. I’m hoping it will go along with the 2600 Router and Catalyst 2950 at the end of my bed and allow me to get a CCNA before the year is out.

I have yet to book my driving lessons which I should really do so I can get out on the road to be raped by the insurance company.

Robb is having his wedding reception on Saturday. Its finally here after all the planning etc. Congrats man!

Thats all I can think of for now but it appears Gavin has tagged me. Arses! I’ll come up with some new stuff to beat the curse.

I also have a beta invite to Joost and I really haven’t had much time to play about with it but can someone tell me what actually content is there? I see like the Paris Hilton channel but is there any channels which show the latest episode of my favourite shows like 24, Stargate (both), Prison Break etc?

No I’m not dead

I’m just a 6th year student who might be dead inside.

Moving on swiftly, I haven’t updated this blog in two weeks mainly because nothing that exciting has happened in the last two weeks. I’ve actually gone out on a saturday night with a friend to a club and ended being pulled onto the dance floor by some random person I did the whole double take look at 5 minutes earlier.

I’m going for my private pilots license with Flightwise where I have one hour of certified flying time already. Now I have to go email them and see when their next groundschool starts. The new server at SoftLayer is working out well so far although getting Ruby on Rails and PHP4 with FastCGI to work properly is turning out to be a pain in my ass.

So thats it for me at the moment, so probably see you in about 2 weeks then.
